This website is provided for the benefit of residents of the United States of America who are over the age of 18. If you are not over the age of 18 or do not agree to be bound by these terms and conditions, you may not use or access this website and we have the right to restrict or prevent your access to the website.

1 ACCESS

We will provide you with access to the website in accordance with these conditions.

2 YOUR OBLIGATIONS

3 INDEMNITY

3.1 You agree to be fully responsible for (and fully indemnify us against) all claims, liability, damages, losses, costs and expenses, including legal fees, suffered by us and arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website, or the use by any other person accessing the Website using your PC or internet access account.

4 OUR RIGHTS

4.1 We reserve the right to:

4.1.1 modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

4.1.2 change these Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

4.2 We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

7 YOUR DATA

7.1 We respect your personal information and undertake to comply with applicable Data Protection legislation from time to time in place.

7.2 You should be aware that:

7.2.1 if we are requested by the police or any regulatory or government authority investigating suspected illegal activities, or upon receipt of a court order, to provide your Personal Information and/or information concerning your activities whilst using the Website we shall do so; and

7.3 We reserve the right in our reasonable discretion to disclose details of your use of the Website in relation to any, or any threatened, Court Proceedings in connection with your use, or the use of anyone under your control, of the Website whether in connection with the matters set out in these Conditions or otherwise.

7.4 Bingoport.com will always endeavour to operate in full accordance with The Data Protection Act (1998) and is registered with the Data Protection Registrar.

8 THE GAMES

8.1 Participation in Bingoport.com is 100% Free. There are no fees associated with playing or winning our game. Our games are 100% fair. Numbers are randomly generated by our sophisticated Random Number Generator software.

8.2 Port Points are the “sweepstakes tokens” of Bingoport.com. Port Points hold no monetary value and are used to participate in our bingo sessions and redeem items from our Rewards Store.

8.3 You (the player) are solely responsible for keeping your account number and password secure and secret. You shall not allow any other person or third party to use or reuse your account, access and/or use any materials or information from the Web site, accept any Prize, or participate in the Games.

8.4 Bingoport.com reserves the right, in its sole discretion and without notice, to add new activities or games to Bingo or to discontinue any activity or game of Bingo at any time. Bingoport.com promotions and winners are subject to management approval and can be discontinued without prior notice.

8.5 If you have any dispute with regard to any outcome in the Game, you must submit your complaint to the Company in writing within fourteen (14) days. In the event of a discrepancy between the result showing on your Bingo software and the Bingo's server software, the result showing on the Bingo's server software shall be the official and governing result of the Game.

8.6 Bingoport.com reserves the right to cancel your account for any reason whatsoever at any time without notice to you. This may occur under, but not exclusively in, the following circumstances. The following can result in termination of your account / loss of chat privileges and/or forfeiture of any winnings:

8.6.1 Offensive Behaviour / Language in Chat

8.6.2 Having/Using more than one account per participating website.

8.6.3 Using multiple windows or other methods to be in more than 1 Bingo room at a time.

8.6.4 Abuse/Harassment of Website, Game, Staff or other Players.

8.6.5 Spamming/Solicitation in Chat. This includes repetition of the same message or broadcasting of advertisements.

8.6.6 If you provide incorrect or misleading registration information.

8.6.7 If you are not of legal age.

8.6.8 If you reside in a jurisdiction where participation in the Game is prohibited by law.

8.6.9 If you have allowed or permitted (intentionally or unintentionally) someone else to play on your Bingo account.

8.6.10 If you have played Bingo at Bingoport.com for reasons other than individual personal entertainment (in other words if you have played in a professional sense or in conjunction with other player(s) as part of a club, or group etc.).

8.6.11 If you are believed to be cheating.

9. FREE BINGO SESSIONS

9.1. These sessions are only open to US residents aged 18 years or over except employees and their families of 1st Leads Limited and its agencies or anyone professional connected with this promotion, who are precluded from entry.

9.2. No purchase necessary. To enter, simply register at the website and play the free bingo sessions that are available.

9.3. Players must be registered to receive communications to be eligible to claim any prizes won.

9.4. The winner of a prize tournament will be decided by the number of Port Points won between the start and end time of the tournament in question. Tournament start and end times are approximate and may begin or end a few minutes before or after the advertised time.

9.5. The tournament winner will be announced in the chat window at the end of the tournament along with the prize they have won.

9.6. For major prize tournaments, the tournament winner will be contacted by email as soon as possible after the tournament has taken place to confirm the delivery of their prize. If the winners do not respond after 30 days of being notified, the promoter may distribute the prize as it thinks fit without any liability to the winner(s) for having done so.

9.7. Players who use multiple windows, multiple accounts or other illegal methods to gain multiple entries into the same tournament will have their account terminated and any winnings will be forfeited.

9.8. The promoter reserves the right to amend, alter or terminate this promotion at any time due to circumstances beyond its control.

9.9. Free Bingo voluntary chat hosts are eligible to play and win the prize tournaments while logged in as their chat host usernames.

9.10. The promoter's decision is binding in all matters.

9.11. Entry instructions are deemed to form part of the terms and conditions and entry into the promotion is deemed to signify acceptance of these terms and conditions.

9.13. The winners may be requested to take part in publicity which may include the use of your name and photographs for publicity material in any 1st Leads Limited publications in any media. To be eligible as a winner you agree to allowing your name to be published on the Website if you are a prize winner.

9.14. These rules are governed by English law and subject to the exclusive jurisdiction of the English Courts.

You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

13. CHAT TERMS OF SERVICE

13.1 Bingoport.com reserves the right to terminate your registration if we become aware and determine, in our sole discretion that you are violating any terms of service. Bingoport.com may at any time change its terms of service without notification.

13.2 Bingoport.com chat room act only as a technical interface between users. The chat room does not itself verify the integrity of the users. Bingoport.com has no obligation to monitor the chat room. Bingoport.com, generally, does not monitor or control any of the exchanges between the users posted to the chat room. Bingoport.com reserves the right, however, to review such content and to take disciplinary action against players, in its sole discretion. Bingoport.com does not endorse any of the exchanges or content posted by players and, therefore, specifically disclaims any liability with regard to such information and with regard to any actions resulting from your participation in the chat room.

13.3 You should use your own judgement in evaluating the integrity of, and statements made by, other users the chat room. Any opinions expressed by a player of Bingoport.com are those of that member alone, and are not those of Bingoport.com. Bingoport.com cannot and does not assume responsibility for the accuracy, completeness, safety, timeliness, legality or applicability of anything said or written by any player of Bingoport.com.

13.4 You alone are responsible for the content of your messages, and the consequences of any such messages.

13.5 Any use by you of any other user's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing) is prohibited. Any such use shall be deemed to be a violation of these Terms of Service. Bingoport.com's chat rooms are to be used by you for your personal use only. Commercial uses of Bingoport.com are strictly prohibited unless prior written consent from the Bingoport.com management team. You agree that you will not use chat room for ‘spamming' or solicitations (commercial or non-commercial).

13.6 You further agree not to post to any chat room any message or material that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, racially offensive, inaccurate, or otherwise objectionable material of any kind or nature or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation, or encourage the use of controlled substances.

13.7 – You further agree not to post any message or material that is vulgar, obscene, profane, or sexually oriented in any chat room.

13.8 – Bingoport.com reserves the right to cancel your account or remove you from chat at any time, without warning, for breaching these terms.

13.9 You agree not to impersonate any other person or entity, whether actual or fictitious, including impersonating an employee or consultant of Bingoport.com. You further agree not to use an inappropriate player name/alias of any kind.

13.10 You agree not to attempt to damage the reputation of Bingoport.com, 1st Leads Limited or that of site sponsors.

13.11 You agree not to transmit or display content containing (but not limited to) any of the following:

Player bashing (including name-calling and “labelling”).
Statements that defame, abuse or threaten others.
Tasteless, bigoted or indecorous remarks.
Any material that endeavours to sell, solicit or aggravate others.
Any material that contains obscene, vulgar or indecent language.
Obscenities or suggestive remarks to players and/or staff.
Deliberate misspellings of words in an attempt to avoid our swear filter.

13.12 Chat should not be worded in any way as to exclude anyone else from the conversation. Examples of such chat include, but are not limited to, speaking in ‘code' and speaking in any language other than English.

13.13 Players should not type solely in CAPITALS as this is considered shouting and is poor chat etiquette.

13.14 You understand and agree that Bingoport.com does not guarantee the accuracy or completeness of any information in given in the Bingoport.com chat room. Bingoport.com is not responsible for any errors or omissions or for the results obtained from the use of such information. Bingoport.com shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced in Bingoport.com.

13.15 Your participation in a Bingoport.com chat room is solely at your own risk. No advice or information, whether oral or written, obtained by you from Bingoport.com or through Bingoport.com, its employees, consultants shall create any warranty not expressly made herein.

14. NOTICES

14.1 You may send us notices under or in connection with these Conditions:

14.2 As proof of sending does not guarantee our receipt of your notice, you must ensure that you have received an acknowledgement from us, which will be sent within 3 working days of our receipt and should be retained by you.

15. LIMITATION OF LIABILITY

15.1 WHILE WE WILL USE REASONABLE ENDEAVOURS TO VERIFY THE ACCURACY OF ANY INFORMATION WE PLACE ON THE WEBSITE, WE MAKE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED IN RELATION TO ITS ACCURACY.

17 WAIVER

18 SURVIVAL

20 LAW

The Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions. The personal information you provide by submitting this form will be collected by 1st Leads Limited who may (i) pass your details to certain third parties to assist them in analysing use of the Website and enabling them to contact you about products or services which may be of interest to you and (ii) use it in accordance with our privacy policy.
